Terms of Service

1. Who we are and accepting these terms

These Terms of Service ("Terms") are an agreement between you, the business owner using our services ("you"), and Nerve, a Texas sole proprietorship ("Nerve," "we," "us"). You accept these Terms when you check the box at the Review step of our online builder and pay your deposit. We save the version you accepted with your project. If you accept for a business, you confirm you can sign for that business. You must be at least 18.

2. Services, packages and the builder

We design, build and launch a website for your business from the choices you make in our builder: your pages, package or budget, add-ons, content, style, layout, design and monthly plan.

  • Scope. Your project includes only what is listed on your Review screen (your "Project Summary"). Anything else is extra and quoted before we do it.
  • Always included. Every site has a contact section, click-to-call, a map and social links at no extra cost.
  • Booking pages use our built-in booking tool, with your services, hours, confirmations and email reminders (see section 11). Ordering and store pages connect to an outside service. A store page holds up to 25 products.
  • Hosting. We build and host your site on our own platform. Your site stays online with us while you have an active plan (see sections 7 and 8).

3. Prices, deposit and final payment

You pay half before we start and half at launch. Prices are the ones shown in the builder when you accept these Terms.

WhenWhat you pay
End of the builder, before any work starts50% of your one-time total (the deposit)
At launchThe other 50%, plus the first month of your plan
Every month after launchYour plan fee
  • Payments go through Stripe. When you pay the deposit, you authorize us to charge the same payment method for the launch payment and your monthly plan.
  • We don't start until the deposit is paid, and we don't launch until the balance is paid.
  • No rush fees. The builder shows your timeline; you can't pay to move it up.
  • Taxes. Prices do not include sales tax where it applies.
  • Failed payments. If a launch or plan payment fails, we'll email you. If it isn't paid within 14 days, we may pause your site until it is.

4. Timelines and your content

Timelines are estimates that start once we have your deposit and what we need to begin.

PagesEstimate
13–4 days
2–44–6 days
54–7 days
6–76–8 days
87+ days
9 or more7 days + 1 day per extra page

Add-ons add time: logo design 3 days; custom design, copy help, store or online ordering 2 days; booking, photo sourcing, basic or local SEO 1 day.

  • Your content. Any logo, photos or text you chose to supply yourself is due before launch, and within 30 days of your deposit.
  • Delays on your side. Late content or feedback moves your timeline back by the same amount.
  • Inactive projects. If we don't hear from you for 60 days after a reminder, we may close the project. Section 6 decides any refund.

5. Revisions and change requests

You get up to 3 rounds of minor changes after we share your first draft.

  • Minor changes include editing text, swapping photos, adjusting colors and reordering sections.
  • Major changes include a new style, a new layout, extra pages or a redesign. We quote these before doing them.
  • New pages or add-ons after your deposit are priced at the builder's rates and added to your launch payment.
  • Approval. You approve the site before launch. After launch, changes come through your Care, Edit or Grow plan. We don't sell one-off updates after launch.

6. Refunds and cancelling a project

How much of your deposit comes back depends on how far the work has gone.

You cancelRefund
Before design startsFull deposit
After design starts, before your first draftHalf the deposit
After we share your first draftNo refund
  • Design starts when we email you that we've begun building your site.
  • To cancel, email will@nervebuild.com.
  • If we cancel because you broke these Terms, the table above applies. If we can't finish for reasons on our side, we refund everything you paid for unfinished work.
  • Monthly plan fees are not refunded for partial months.

7. Monthly plans

Every live site needs at least the Host plan. Billing starts at launch and renews each month on your launch date until you cancel.

PlanPriceWhat it covers
Host (required)$25/moHosting, your domain, security, backups and the edit screen for changing text yourself
Care$50/moEverything in Host, plus up to 2 small info changes a month done for you, like hours, phone or prices
Edit$50/mo + page feesEverything in Care, plus we keep your changing pages up to date: $25/mo per page that changes often, $15/mo per page that changes sometimes
GrowEdit + $75/moEverything in Edit, plus ongoing SEO work
  • Unused changes don't roll over to the next month.
  • Switching plans takes effect at your next billing date.
  • Cancelling. Email us at least 30 days before your next billing date. Your plan runs to the end of the period you paid for. Cancelling Host takes your site offline (see section 8).
  • Price changes. We'll email you 30 days before any plan price changes.
  • Your own edits. You're responsible for changes you make in the edit screen. If something breaks, we can restore a backup.

8. Domains, hosting and leaving Nerve

You can leave at any time, and your domain goes with you.

  • New domains. We register your domain in your name, and the Host plan covers its yearly renewal while your plan is active.
  • Domains you already own stay yours. You point them to our hosting.
  • When you cancel Host, your site goes offline at the end of your paid period. If you ask within 30 days, we will transfer your domain to you at no charge and send you your content: text, images and logo files.
  • Backups are kept for 30 days after cancelling, then deleted.
  • Uptime. We use a well-known hosting provider but can't promise your site will never go down.

9. Ownership and licenses

You own your content and, once you've paid in full, your site's design. We keep the tools we use to make it.

  • Your content (logo, photos, text you give us) stays yours. You let us use it to build, host and show your site.
  • Your site's design. Once you've paid in full, you own the finished design and content of your site as delivered.
  • Our tools. Nerve keeps ownership of the builder, the 12 styles, layouts, templates, code and tools behind your site. You may use them as part of your site while it's hosted with us.
  • Logos we design are yours outright once paid in full, and we send you the files.
  • Stock photos we source are licensed, not owned. You may use them on your site and your social media under that license.
  • Until you pay in full, everything we made for you belongs to Nerve.

10. Your responsibilities and acceptable use

You're responsible for what your site says and sells.

  • Rights. You confirm you own or have permission to use everything you give us.
  • Accuracy. You're responsible for your prices, hours, licenses and any notices your industry requires, such as a brokerage notice for real estate agents.
  • Health information. Our forms collect contact details only. Don't use your site to collect health information.
  • Not allowed: illegal products or services, content you don't have rights to, and content that is deceptive, hateful or sexually explicit. We may refuse or remove it.
  • Your edit screen. Keep your login private. You're responsible for changes made with it.

11. Third-party services, SEO and results

Some features depend on other companies, and nobody can promise search rankings.

  • Built-in booking. Your booking page runs on our system while you have a monthly plan. You set your services, hours and rules, and you're responsible for honoring bookings and your cancellation policy. We aren't liable for missed appointments, no-shows or lost business if a booking, email or reminder doesn't go through. Don't use booking to collect health information. If your plan ends, we'll send you an export of your bookings.
  • Outside services. Online ordering, store checkout, maps and your Google Business Profile run on other companies' services, such as Square, Toast or Stripe. You may need your own account, you pay their fees, and their terms apply.
  • SEO. Basic SEO, Local SEO and the Grow plan improve your chances in search. We can't guarantee rankings, traffic, calls or sales.
  • Examples. Results shown on our site are past examples, not promises.

12. Warranties, liability and indemnity

We stand behind our work, within limits.

  • Our promise. We'll do the work carefully and professionally. For 30 days after launch, we fix anything that doesn't work as built, at no charge.
  • Otherwise as is. As far as the law allows, we make no other promises about the services.
  • Limit of liability. Our total liability for any claim is limited to what you paid us in the 12 months before the claim. We aren't liable for lost profits or indirect damages.
  • Indemnity. You'll cover our costs if someone makes a claim against us because of your content or your business.
  • Events outside our control, such as outages, disasters or provider failures, excuse delays they cause.

13. Portfolio, confidentiality and privacy

We may show your site as our work, and we keep your private details private.

  • Portfolio. We may show your site and a short project description on our Work page and social media, and add a small "Built by Nerve" link in your footer. Email us to opt out of either.
  • Confidentiality. Anything you share that isn't on your public site stays private and is used only for your project.
  • Your data. See our Privacy Policy.

14. Disputes, governing law, changes and contact

Talk to us first. Texas law applies.

  • Disputes. Email us first; we'll try to resolve it within 30 days. If we can't, disputes go to the courts of the Texas county where Nerve is based.
  • Changes to these Terms. New versions apply to new projects. For monthly plans, we'll email you 30 days before a change takes effect.
  • Whole agreement. These Terms and your Project Summary are the whole agreement. If they conflict on price or scope, your Project Summary wins.
  • Contact. will@nervebuild.com
